The following terms and conditions apply to all contracts, deliveries and other services of TCW THE CLEAN WATER Company GmbH® in the following called "TCW". Differing rules of the contractor, we hereby expressly oppose. All ancillary agreements require our written confirmation.

TCW is entitled at any time to amend or supplement these terms and conditions with a reasonable period of notice. Before incoming orders are processed according to the known terms and conditions.

2. Offer
Our presentations on the internet are not binding. Small deviations and technical changes due to technical progress or legal regulations in relation to our illustrations or descriptions are possible. The respective documents lose their validity with the appearance of a new edition.

3. Terms of delivery
We work according to the conditions of "INCOTERMS 2010" (at the end of the Terms and Conditions).4. Delivery times
The delivery times depend on the order confirmation received by the customer. If the failure to meet a delivery or performance deadline is due to force majeure, labor disputes, unforeseeable obstacles or other circumstances for which we are not responsible, the deadline will be extended appropriately.

Failure to comply with the delivery deadline other than the above. TCW warrants that the goods sold are free from defects in material and workmanship at the time of transfer of risk and have the contractually guaranteed properties. The warranty is valid for 2 years from the date of purchase. In case of complaints must be proven with an invoice.

The warranty expires if defects arise as a result of the customer improperly changing the delivered goods or storing them improperly. The buyer can as a remedy the elimination of the defect and after three failures of the subsequent performance demand reduction or withdraw from the contract.

6. Retention of title

8. Jurisdiction
Place of fulfillment and place of jurisdiction for both parts is the seat of TCW. It is only the law of the Federal Republic of Germany.

9. Severability clause
Should individual provisions be or become void, ineffective or contestable, the remaining provisions shall remain unaffected and shall then be applied or supplemented so that the intended economic purpose is achieved as precisely as possible in a legally permissible manner.
